A listing contract (or listing agreement) is a contract between a real estate broker and an owner of real property granting the broker the authority to act as the owner's agent in the sale of the property. If the broker is a member of the National Association of Realtors, the agreement must include all of the following terms: 1. A beginning date and a termination date. 2. The list price at which the property will be offered for sale. 3. The amount of compensation offered to the broker, whether it is in the form of a flat fee or percentage of the sales price. 4. The terms and conditions under which the brokerage fee shall be paid by the seller. 5. Authorizes the broker to co-operate with other brokers as sub-agents or buyer's agents and details the compensation to be offered to those brokers in the event they procure a buyer. 6. Authorizes the broker to reveal or not to reveal the existence of offers previously received. In addition, other terms which may appear in the agreement can include: Authorization to the broker to post a sign, to advertise the property, and to put a lockbox on the door, as well seller's obligations to advise the broker on the condition of the property, and broker's obligations to advise the seller about regulations and laws which may affect the sale. Typically, separate listing agreements exist for the sale of residential property, for land, and for commercial or business property. Upon listing the property, the real estate agency tries to obtain a buyer for the property and, in consideration of successfully finding a satisfactory buyer, the broker anticipates receiving a commission (fee) for the services the brokerage provided.

I have worked with the best in real estate. I have worked with real estate entrepreneurs, real estate lender lenders, real estate attorneys, real estate investors. I have done conventional real estate sales, I own a property preservation company. Back to real estate listings. Ok let us say that you have a good listing, the seller is motivated. Having a good sellable listing is like having money in the bank. The property owners / sellers hired you listing broker - listing agent. They signed an exclusive agency listing with you. You must be a licensed real estate agent, or a licensed real estate broker. They need to sell and sell fast. You put the property up to the MLS - Multiple listing service. The multiple listing service is where all the available properties “FOR SALE” are listed. The ones that are available for sale will be label “Active”, the properties under contract will be labeled - pending, the properties that escrow has closed are labeled sold or closed. It may vary for the MLS in your area. You put your listing on the MLS. While you are out getting more listings or on Saturday morning when you are with your family there will be selling agents/ buyers agents working for you / showing your listing(s), the property that is sale, deciding - seeing if they want to submit an offer. The buyers agents that show your listings. If the buyers decide to submit an offer. The buyer's broker/buyers agents will write up the offer. The buyers agent will then tender the offer to you the listing agent. There will also motivated buyers that are looking through MLS that will be interested in your listings. There serious / motivated buyers will contact you and ask you to represent them These are sophisticated buyer/investors that know they are more likely to get the property if they work with the listing agents. Discount Listing Agent When you a listing agent gets a listings the normal fee to list and sell a property is 6%. There are discount listing brokers and listings agents that take listings for $500 bucks and some for 1%. That is not what I am talking about here. I will show you how to get full 6% commission listings. No discount brokers or agents here. This is how it works You have you active listing in the MLS In a low inventory market you could recieve 20 plus offers on you listings, the property could be a tear down, a completely refurbished house, it does not matter you will receive offers, even if the listing is overpriced. In Listing Generation System I show exactly how to get listings in Low Inventory Markets. Accepting an Offer Buyers Agents - for their clients will send you their offers You - the listing agent may also have offers that you wrote up for buyers. When they saw your listing / property in the MLS. You the listing agent will work with the sellers / the property owners and advise them which is the strongest offer for them to accept. I was representing the sellers. It was my job to have their best interest / protect them. If I wrote up an offer for a buyer and the offer was 5k less than the highest offer. But the highest offer was going to get 100% financing. My offer was 5K less but all cash and close in 21 days. That is better for the sellers. Just to keep things simple here. Lets us say that the property owner is going to accept the strongest offer. But there could be multiple offers, with counter offers. Let’s keep things simple. You will learn all of these exciting things once you are in real estate and you have your first 2-3 listings and your phone is ringing off the hook. Active Listing to Pending After review the offers that came in. The seller/property owner is going to accept the strongest offer.

This means that the broker will only be able to collect a commission if he or she finds a buyer or tenant, and the owner can always find their own buyer and not owe any commission. What Is an Exclusive Listing vs an Open Listing? An exclusive listing is just as it sounds, a real estate listing where one broker exclusively lists and markets the property for sale or rent. There are actually two common variants of exclusive listings: Exclusive Right to Sell or Rent – This is the most common type of sale listing. The listing broker is the only one who can list and market the property, and will collect commission regardless of who finds the buyer or tenant. If the buyer is represented by a broker, the listing broker will typically split the commission with the buyer’s broker. Exclusive Agency – This type of listing agreement is less common. The listing broker is still the only person who can list and market the property. However, if the owner finds a buyer or tenant by themselves, they do not owe any commission to the listing broker. Are Open Listings Common for Rentals? Yes. Open listings are predominantly seen in the rental market vs the sales market, and especially so when it comes to large, landlord buildings in NYC. These landlord buildings are essentially entire apartment buildings that are owned by one landlord, and where all or almost all of the units are rentals. While many individually owned condo and co-op apartments will still be listed exclusively by a single broker, most large rental buildings will not have an exclusive listing agent. This is because these landlords are institutional in nature, and have a history of paying commission to brokers for bringing renters. As a result, they don’t need a broker to list it on their behalf in the REBNY RLS, because doing so essentially provides credibility. Furthermore, many of the building landlords don’t want to bother with marketing their own properties, and the associated expenses with doing so. Are Open Listings Common for Sales? Open listings are very rare in the residential sales market, primarily because most MLS broker databases and even many public websites won’t allow anything but exclusive sales listings. As a result, buyers typically have an easier time navigating the sales market because there is only one agent listing each property, which results in far less confusion vs the rental market. Can I Sell FSBO and Access the RLS Through an Open Listing? No. As clever as the idea of using a broker to access the RLS through an open listing is, it’s simply not allowed. The REBNY RLS specifically prohibits non-exclusive sales listings to be uploaded to the broker database, and any broker who surreptitiously uploads an open listing can suffer fines and other penalties. Furthermore, many MLS systems such as the Hudson Valley’s HGMLS will require the listing broker to upload the actual signed listing agreement for review by the MLS staff. How Can I List FSBO on the RLS Without Paying 6%? Sellers who sign up for an Agent Assisted FSBO listing through Hauseit will be paired with a traditional partner broker who has already agreed to list your property on your local MLS for a small, one-time flat fee. Residential Listing Agreement - RLA - Tutorial

Visit http://oorp.org for more real estate forms. Please comment with questions This video is a tutorial on the residential listing agreement OORP formed 200. This form is conveniently numbered on the left hand side. So we begin with the seller names on line 1, line 3 is going to authorize the brokerage. So you're going to put the company name, the brokerage name not the agents name. Line 5 is the property address. Line 6, the assessor's parcel number and then the county. Line 7 is going to be when this listing period begins. Line 8 is when this listing period expires. Come to the brokerage charges section. Line 10 is going to be where you put a percent if you're going to take a percentage based listing. If not you can modify that. So in this case we have a default number 6 percent. If you check this box see the word and this adds on. So let's say you want to add a flat fee for a transaction coordinator you could check this box and you could add $500. Or if you wanted to not do the percentage or add a flat fee on top of that you could check this box and you could just do a flat fee listing amount. So we could get rid of this and this then becomes a $10,000 flat fee Commission listing rather than a 6 percent listing how we originally had it by default. This form has a provision in it that lasts for 90 days. That protects the listing agent in case the listing period comes to an end and a buyer that has expressed interest in seeing the property makes an offer right after this agreement expires, the listing agents protected. So 90 days is the default verbiage if you want to extend that period, you could put in whatever number you want we just put 120 days in as an example and this is verbiage that pertains to the protection clause for the agent, and then also in case the seller tries to sabotage the listing it protects the listing agents position. Broker cooperation obviously this is where you're going to offer the compensation to a broker that brings a buyer. So let's say you did a 6% listing on top just to make an example we did 3% here, if you wanted to just offer a different number you put it there, or let's say you want to do a flat fee you just put the flat fee amount right over here, this is an advisory advising sellers as to the purpose of the Multiple Listing Service, so they're properly notified as to how that fits into the scope of marketing their listing and if the seller wants to exclude from the MLS, there's a section here that allows them to initial and in the broker initials and this then acts as an exemption or exclusion from the property automatically being uploaded into an MLS system. We have a section of marketing, so by default the listing broker is authorized to place a key box on the premises and by default listing broker is authorized to place a for sale sign. In the case that the seller does not want either one of these on premises then, they'll just go ahead and check one of these boxes here but this is a way to clarify that the listing broker does have permission and to show in writing that the seller has been informed that the brokers property, meaning of for sale certain lockbox, is going to be on premises. There's a sexual and dispute resolution and where the venue should be in case some sort of dispute arises and mediation is the first course of action. There's default overage you can read about seeking mediation in case the seller and listing broker have some sort of dispute that needs to be mediated and then there's some other representations these are basically provisions that the seller should be aware of and that the listing broker should include in a listing contract. Then we have a section here for additional provisions anything that's not explicitly mentioned above can be written in down here. Then we conclude the form on the third page, so the seller is affirming that they understand all the terms on the agreement, and they're going to print their name and sign and date and the listing broker is going to actually in this listing broker section the listing agent is who's going to sign this section, and that concludes the residential listing agreement form
