You can also approach your union (if there is any) and try to sort out/communicate your issue through them. In certain cases you may be required to send legal notice to your company/contractor/employer or file a case against them in court. Have you ever had a bad experience with a company? Do you remember your frustration as you tried to resolve the issue? This week we're going to show you how to work with your Attorney General. Transcription: Hello, and welcome to Your Money 2.0. I’m Thomas Fox, Community Outreach Director at Cambridge Credit Counseling. Have you ever had a bad experience with a company? Do you remember your frustration as you tried to resolve the issue? Well, if you’re battling over poor service, misleading advertising, or unscrupulous scam artists, there is a way for you to receive help through your Attorney General’s office. Each year, hundreds of thousands of consumers contact their state’s Attorney General for assistance; unfortunately, even more people decide not to file complaints, often because they’re unsure about the resolution process or think that’s it’s going to cost them a lot to pursue the matter. Well, this week we’re going to show you how to work with your Attorney General. First things first - before filing a complaint with your attorney general you should attempt to resolve the issue on your own. Before contacting the business in question, put your concerns on paper and gather any corresponding records. To keep things simple, make a bulleted list of details that will aid you in the resolution process. You may also wish to make this a ‘living document,’ where you can add critical information if you need to elevate your complaint to management, the attorney general, or any other consumer protection agency. Some helpful information to gather would include the time, the date or dates of interaction, the name of the representative you dealt with at the company in question, and an overview of the conversation. You should also do some research about the company’s own complaint resolution process. Remember: you’re not obligated to follow their procedure – you’re free to contact the attorney general at any time, but the company’s process may be all you need to come to a satisfactory conclusion. Once you’ve outlined your concerns and gathered pertinent information, contact the organization to begin the dispute process. Cooler heads generally prevail in these situations, so be sure to stay calm and stick to the facts. Detail your concerns, and the specific actions you expect from the company to set things right. If you find the representative unhelpful, it’s ok to request to speak with their supervisor. These individuals have more latitude than their subordinates, and it can’t hurt to get a decision-maker on the phone if things don’t seem to be going your way. If you’re dealing with a reputable service, most consumer issues can be resolved this way. However, if you are still encountering difficulties, send a letter to the company’s president outlining your issue and the interactions you’ve had so far. Be sure to include your name and telephone number, and keep things brief. If these efforts don’t work, file a formal complaint with your State Attorney General’s office. It’s important to realize the Attorney General will not provide legal advice; however, they are powerful advocates to have in your corner. Your complaint should detail your issue, the steps you’ve taken to remedy the situation, and any other information that would be helpful to their office. Once you file a complaint a few things can happen. The AG may forward your concerns to a local consumer group or to another state or federal agency for review. If so, you’ll be notified of the agency that will be handing your complaint. It will take time, so be patient. In some instances the Attorney General’s office will place your complaint with a mediator who will work with you and the business in question, to resolve the issue. Mediators are typically located in your community, and can be powerful resources for consumers. They’re knowledgeable about the possible legal implications of your complaint, and they can provide you with an advocate who is well versed and adequately prepared to support you. Another benefit of mediation is that you’ll have someone with whom you can meet face-to-face to discuss your concerns. It is important to note that businesses are not required to participate in mediation; however, many will choose to resolve a complaint in this manner. Your Attorney General’s office can be your best ally, and the source you may need, in resolving disputes, but they can’t get involved unless you take the first step and let them know about the situation. I know that it can feel like nobody is listening, but there are people and processes in place to help you every step of the way. If you feel you’ve been wronged by a business or other service provider, you don’t have to be a victim. Contact your Attorney General for advice and support. 5 Steps to File a Lawsuit to Collect Business Debt
You may have loaned money to a small business or sole proprietor. However, when it came time for the other party to pay the debt, that party may have paid you back less than the full amount or rebuffed the loan completely. At this point, you will have to consider filing a lawsuit to collect the business debt -- starting with knowing the general steps to filing the lawsuit: 1. Filing The Complaint. The complaint is the legal document that officially starts the lawsuit. The complaint is a formal document and you may want to work with an attorney to ensure that you meet all the legal requirements. In the complaint, you will be the plaintiff and the debtor will be the defendant. Depending upon the nature of the loan, there may be multiple debtors and creditors. 2. Serving The Complaint. You will serve the complaint and summons to the defendant. The summons lets the defendant know that he or she is being sued and will give the basic information as to the timelines for filing a response. You should be aware that specific jurisdictions provide specific requirements for how the summon must be served such as personally or via mail. 3. Choosing The Proper Venue. You will need to consider where to file the lawsuit and which court is most appropriate. For example, debt involving real property likely should be filed in the jurisdiction where the property is located. Also, depending upon the amount at stake, you may want to consider filing the lawsuit in small claims court, superior court, or some other court. 4. Awaiting The Answer. The defendant will be afforded an opportunity to draft a response and argue why the lawsuit is meritless. The defendant typically must file this response within the given court timelines. 5. Working With An Experienced Attorney. You may want to work with an experienced attorney from the very beginning of the lawsuit. An attorney can ensure that your complaint is property filed and that all the legal steps are taken. Your attorney can also negotiate with the defendant and represent your interests in court.

Consumer refers to any person who purchases some goods for a consideration that has been either 1.paid or promised to pay or 2.partly paid and partly promised, or 3.found under any system of deferred payment and does include any user of this type of goods other than the person who purchases these types of goods for consideration paid or promised or partly paid or partly promised, or 4.under any type of system of deferred payment when this type of use is done with the agreement of such person, and does not include a person who gets such goods for resale or for any business purpose or hires or avails of some services for a consideration which has been paid or promised or partly paid and partly promised, or 5.under some system of deferred payment as well as includes some beneficiary of such services other than the people who ‘hire or avail of the services for consideration paid or promised, or partly paid and partly promised, or 6.under any system of deferred payment, when such services are provided having the approval of the first described person and does not include a person who takes such services for any business purposes. Consumer Court is the special purpose court, in India, that deals with cases regarding consumer disputes and grievances. These are judiciary hearings set up by the government to protect the consumer rights. To lodge a complaint, the consumer has to first register on the site. The online registration form has to be filled in with the name, email, address and phone number of the complainant, and an user id and password have to be created. All Up In Yo' Business: What is a Registered Agent?
When you’re starting a business, whether it be a limited liability company (LLC), a corporation, or some other business entity, you are going to have to list your company’s registered agent when you file the Articles of Organization/Incorporation. So what is a registered agent? Simply put, the registered agent is the person who is going to get served (insert funny reference to the 2004 movie here) if the company is ever sued or issued a court summons. A little civil procedure education for you: when you sue somebody, you are required to serve them with process within a certain amount of days from when you file the complaint (the complaint is the document that basically gets the lawsuit ball a-rollin’). This way the person you are suing knows that they are being sued. So the registered agent is the person or business that will accept that service of process in the event of a lawsuit. That is the registered agent’s sole responsibility; they do not have any sort of ownership or management interest in the business just by virtue of being the registered agent. And who can be a registered agent? The rules regarding registered agents will vary state-to-state. Colorado only requires that the person (if it is a person) be 18 years or older and have a primary residence in Colorado. You can also appoint a business as registered agent. Either way, the person or business must consent to being the registered agent and must have a physical address (i.e. not solely a PO box) in Colorado. You have a few options when choosing your registered agent. 1) You/your business can be your own registered agent, or 2) there are a lot of companies/law offices (*hint hint*) that offer registered agent services. There’s nothing wrong with being your own registered agent. It is perfectly legal and won’t open you up to any more risk of liabilities. But let’s say, for example, you have a home office so you put yourself as registered agent and your home address as the registered agent’s address. If you ever get sued, you will have the process server knocking on your front door (which may be embarrassing if you have nosy neighbors). And Colorado allows the process server to leave the documents with any adult who resides at registered address. So if your 18 year old son is the lucky one to answer the door, the process server may leave the documents with him and he will have the responsibility of giving it to you. Or if you have a store front and use that as the registered office, you may get served while you have customers or clients around. Those are the pretty typical reasons not to be your own registered agent. Outsourcing this to a registered agent company will help avoid those possible consequences and those companies are usually pretty reasonably priced. For example, I offer registered agent service in Colorado starting at just $100/year. These companies will also come in handy if you expand your business into another state or have offices/employees located in other states. Most states require that you register as a foreign LLC or foreign corporation if you do a lot of business in that state. That will require you to have a registered agent located in that state. 10 Free Facilities on Petrol Pump For Everyone in Hindi | By Ishan Very few of us know that we are entitled to various rights and benefits at the petrol pumps which the staffs are bound to oblige. Here, know all your rights: 1. Right to check the quality of oil: Every consumer has the right to check the quality of diesel or petrol at the filling stations. They are entitled to know whether they are getting the right kind of fuel in exchange for their money. If the petrol pump staff don't allow you to check the quality, you can either write a complaint in their register or you can lodge a complaint on http://pgportal.gov.in/. 2. Right to check the quantity: Every petrol pump must have a 5-litre measuring jug to check the quantity of petrol or diesel and this measuring jug must be checked by investigation centre every year for weight and capacity. A difference of 25ml is acceptable but if the deviation is more than that, you should file a complaint to the petrol pump manager. 3. Right to check the density of petrol, diesel and other fuels: Apart from the quality and quantity, you are entitled to check the density of the fuel. There is a 500ml cylinder at every petrol pump to check the density which is filled to about ¾ height with the help of nozzle. After that, an instrument named (American Society for Testing of Materials) is dipped in this beaker which gives the reading for temperature and density of the product. This reading is compared with the one mentioned in the register which acts as the reference. Both the reading should be same. 4. Filter paper test (for petrol): If you doubt the quality of petrol, you can go for this test. Under this test, the nozzle of dispensing pump is cleaned with the filter paper and then a drop of petrol is added to the filter paper. If the drop turns pink, the petrol is pure but if some other colour appears, the petrol is adulterated. 5. Right to ask for bill: It is your right to ask for the bill of the fuel to get filled in your vehicle. The bill has the description of the amount and the taxes you have to pay in return for the fuel. In case the attendant at the filling station denies providing you with the bill, you can make a complaint against him. Here are some facilities which you get free of cost at the petrol pump: 1. Free Air: Every filling station provides the service of free air to the consumers who get fuels filled in their vehicles. If the attendant at the air pressure counter asks you for money, you can file a complaint against him at the main counter. 2. Free Drinking Water: You are entitled to get free drinking water at the petrol pump. Every petrol pump is bound to provide the facility of free drinking water to their consumers. 3. Free Toilet Services: Unlike the railway stations or municipal toilets, you can't be charged for using the washroom at the petrol pump. If the staff at the filling station asks you for the money, you can file a complaint against him. 4. First-Aid Facility: In the case of any injury or wounds, you are entitled to get first-aid at the petrol pumps. If the petrol pump staff fails to provide you with the first-aid you can make a complaint against him. 5. Complaint Register; If you are not satisfied with any services of the petrol pump, you can write your complaint in the complaint register available at the petrol pump. It is mandatory for every filling station to maintain a complaint register. 6. Firefighting Instruments: Every petrol pump should have fire fighting instruments in case the station catches fire. The safety equipment as per statutory requirements is fire extinguishers, sand buckets etc. 7. Display of fuel prices and working hours: It is the right of every consumer to know the fuel prices of that particular filling station. So it is mandatory for every petrol pump to display the prices in bold letters. Also, the working hours should be displayed in bold letters. 8. Free phone call: In the case of any emergency, every consumer is entitled to get free phone call service. If the petrol pump staff don't allow you to make a call or charges you for the same, you can make a complaint. Entertainment Venue Garnering Noise Complaint From Nearby Businesses
DAYTON -- A new business in town is causing a headache for a number of its neighbors. Business owners are complaining a new wrestling and concert venue is simply too loud.Rockstar Pro Wrestling arena is located on East 3rd. Directly accross the street from Ann Troup's Hidden Treasures shop. Ann says the loud music has damaged glass shelves in her store. "It reverberates my whole shop! That one just crashed and the dishes fell out and broke and I know its from the magnitude of this base that comes out of there," Troup explained. "I have to think there are no acoustics whatsoever in that building. I think it's an old factory." Neighboring Artifex finishing company owner David Couch says he used an iPhone app to measure the noise. "Registered 70 to 80 decimals 500 feet away," Couch told us Friday. "Those limits are being exceeded signifigantly." Dayton Police tell us they are investigating the complaints and they will enforce the noise ordinance if necessary. These business owners say they like their new neighbor and don't want to see them leave, they just want them to do what's neccesary to adhere to the law. "It may or may not be expensive to modify those buildings but that was the choice taken when they choose to use that building for that. You still have to live within the codes and ordinances," Couch said firmly. We did talk to the owner of RockStar Pro Wrestling, Chad Parker, late Friday night. He told us, the illegal noise complaints against his business are unfounded.Parker says they've been in business for 3 years and have never received a citation or been in trouble of any kind.Parker says they will work with investigators to put the complaints to rest.
