If you have a problem with a purchase, the first thing you should do is complain to all your friends on social media… EXP: No, not at all! I have the Consumer Action Handbook here, and it says the first thing you should do is inform the seller about the problem. Most complaints are actually resolved that way. And do it as soon as possible because some stores offer limited time for returns and refunds. If your problem is not resolved on the first try, ask to speak with a supervisor or manager. Sometimes it’s just a matter of knowing who to talk to in order to resolve the issue. PST: That’s what I was saying … So in other words, if you didn’t like the final score of the game you watched last night, you should complain immediately so you can get your money back… EXP : No! It doesn’t work that way… I think I’ll need to be more clear…Look, Professor, if, for example, you buy a television set, and you carefully take it home, then you unpack it and the screen is cracked, then you should make a complaint at the place where it was purchased. PST: And if I didn’t like the game that I watched on that television, can I return it? EXP: He’ll never understand… Back to the topic of how to file a complaint… PST: You should meet my friend Luis; he’s an expert at complaining! EXP : Professor…So if the complaint is not resolved after contacting the seller, you should begin a formal process by writing to the business in question, and express your complaint following these recommendations: One : Start by keeping a record of everything that’s happened. Two : Contact the seller or manufacturer. Explain the problem in detail, but be brief and to the point, and state whether you want a refund or an exchange, and how long you are willing to wait for a response. Don’t be threatening or rude. That won’t help you. Provide your name, address and your phone number so they can contact you. Three : If the problem does not get resolved there are various other options that you can consider, like contacting trade associations or national consumer organizations. Four : You can also contact local or state consumer protection offices, or the closest BBB . PST: Oh yes, of course, Big Bad Business EXP: No professor the BBB is the Better Business Bureau, which is a nonprofit organization that helps resolve consumer complaints. PST: Now everything is starting to become clear. If I have a complaint about a product that I’ve purchased, I should call to complain, and if it’s not resolved, I should write to the seller. And if it is still not resolved, I should contact the closest consumer protection agency … EXP: Very good, that’s right. And by the way, there are also small claims courts in case none of these options resolve the problem. EXP: Is it clear now, Professor? PST: Crystal clear. Have you ever had a bad experience with a company? Do you remember your frustration as you tried to resolve the issue? This week we're going to show you how to work with your Attorney General. Transcription: Hello, and welcome to Your Money 2.0. I’m Thomas Fox, Community Outreach Director at Cambridge Credit Counseling. Have you ever had a bad experience with a company? Do you remember your frustration as you tried to resolve the issue? Well, if you’re battling over poor service, misleading advertising, or unscrupulous scam artists, there is a way for you to receive help through your Attorney General’s office. Each year, hundreds of thousands of consumers contact their state’s Attorney General for assistance; unfortunately, even more people decide not to file complaints, often because they’re unsure about the resolution process or think that’s it’s going to cost them a lot to pursue the matter. Well, this week we’re going to show you how to work with your Attorney General. First things first - before filing a complaint with your attorney general you should attempt to resolve the issue on your own. Before contacting the business in question, put your concerns on paper and gather any corresponding records. To keep things simple, make a bulleted list of details that will aid you in the resolution process. You may also wish to make this a ‘living document,’ where you can add critical information if you need to elevate your complaint to management, the attorney general, or any other consumer protection agency. Some helpful information to gather would include the time, the date or dates of interaction, the name of the representative you dealt with at the company in question, and an overview of the conversation. You should also do some research about the company’s own complaint resolution process. Remember: you’re not obligated to follow their procedure – you’re free to contact the attorney general at any time, but the company’s process may be all you need to come to a satisfactory conclusion. Once you’ve outlined your concerns and gathered pertinent information, contact the organization to begin the dispute process. Cooler heads generally prevail in these situations, so be sure to stay calm and stick to the facts. Detail your concerns, and the specific actions you expect from the company to set things right. If you find the representative unhelpful, it’s ok to request to speak with their supervisor. These individuals have more latitude than their subordinates, and it can’t hurt to get a decision-maker on the phone if things don’t seem to be going your way. If you’re dealing with a reputable service, most consumer issues can be resolved this way. However, if you are still encountering difficulties, send a letter to the company’s president outlining your issue and the interactions you’ve had so far. Be sure to include your name and telephone number, and keep things brief. If these efforts don’t work, file a formal complaint with your State Attorney General’s office. It’s important to realize the Attorney General will not provide legal advice; however, they are powerful advocates to have in your corner. Your complaint should detail your issue, the steps you’ve taken to remedy the situation, and any other information that would be helpful to their office. Once you file a complaint a few things can happen. The AG may forward your concerns to a local consumer group or to another state or federal agency for review. If so, you’ll be notified of the agency that will be handing your complaint. It will take time, so be patient. In some instances the Attorney General’s office will place your complaint with a mediator who will work with you and the business in question, to resolve the issue. Mediators are typically located in your community, and can be powerful resources for consumers. They’re knowledgeable about the possible legal implications of your complaint, and they can provide you with an advocate who is well versed and adequately prepared to support you. Another benefit of mediation is that you’ll have someone with whom you can meet face-to-face to discuss your concerns. It is important to note that businesses are not required to participate in mediation; however, many will choose to resolve a complaint in this manner. Your Attorney General’s office can be your best ally, and the source you may need, in resolving disputes, but they can’t get involved unless you take the first step and let them know about the situation. I know that it can feel like nobody is listening, but there are people and processes in place to help you every step of the way. If you feel you’ve been wronged by a business or other service provider, you don’t have to be a victim. Contact your Attorney General for advice and support. If you have ever watched any courtroom movie or television show, then you probably know the language of this process, but the words can sometimes be confusing. In this video, HensonFuerst managing partner David Henson walks you through the stages of a lawsuit and the timeline involved at every step. Hi, I'm David Henson, Managing partner with HensonFuerst Attorneys. Once the decision is made to file suit in your automobile wreck or other personal injury case, your lawyer leaps into action. The first major step is to research the applicable laws as they relate to the specific facts of your case. Then, we draft the lawsuit paperwork, which is called the "complaint." After the complaint is filed at the courthouse, the court issues official notices of the lawsuit, called "summonses." These summonses and the complaint are sent to the sheriff, who delivers them to the defendants. This part of process, from filing suit to serving the defendants, takes about two to three weeks to complete. Defendants then have thirty days to file an answer to the complaint, although this is usually extended to sixty days by the defendants' attorney. Once the answer is filed, the next step is called "discovery," which is where each side gets to learn (or "discover") all of the basic facts of the case. There are typically two parts of discovery: written and oral. Written discovery involves the exchange of written questions known as "interrogatories." The defense lawyer will send us written questions regarding how the accident occurred, your previous medical history, and your injuries. We also send similar written interrogatories, asking the other parties questions about how the accident happened, eyewitnesses, defenses they may have, etc. Each side has thirty days to answer those interrogatories, but, again, this is usually extended to sixty days. After the written discovery, the next step is "oral discovery," when lawyers get to ask questions in person. The lawyers for both sides gather with the plaintiff and defendants to take "depositions," which are sworn statements, questions answered under oath and then typed into a transcript. We always advise our clients in detail about what to expect during a deposition so they are not taken by surprise during the questioning. Once depositions are completed, the next step is usually "mediation," which is a court-ordered process to see if there is any way to avoid going to court. A specially trained mediator works with both sides to open lines of communication and facilitate settlement discussions with the hope that the parties can resolve case on their own. The mediator does not make any binding decisions, but simply determines if there is any room for negotiations within the context of the lawsuit. A great number of cases settle at mediation. If mediation doesn't work for your case, then we proceed with the case by picking a trial date, and conducting depositions of witnesses, your treating physicians, and any other people who might have relevant information. Once we have all that information, we can complete preparations to have your case heard in a trial before a judge and a jury. We tell clients to expect a one-and-a-half to two-year period from the date they file suit until their case goes to trial. Although the attorneys at HensonFuerst try to move each case as quickly as possible, unfortunately, the legal system in North Carolina is complicated, with intricate rules and requirements that keep cases moving slow as molasses. As your attorneys, our job is to move your case as swiftly as possible, while also building your case as strong as possible so that you stand the best chance of being fully compensated for your injuries.

A collection agency is a business that pursues payments of debts owed by individuals or businesses. Most collection agencies operate as agents of creditors and collect debts for a fee or percentage of the total amount owed. Each country has its own rules and regulations regarding them. Debt collectors who work on commission may be highly motivated to convince debtors to pay the debt. These practices are highly regulated by The Fair Debt Collection Practices act, State laws to protect consumers, and the Consumer Financial Protection Bureau (CFPB), the Federal Trade Commission,and State regulatory agencies. Several Federal and State higher courts decisions have outlined several bad practices; Heintz vs. Jenkins,In re: Vinhee, Mcollough vs. Johnson, Rodenburg, Lauinger, Komarova v. Nation Credit Acceptance Inc. In the US, the FDCPA prohibits calls to the debtor if the call will cost the debtor toll charges (in most other countries recipients of telephone calls are not charged, so this issue does not arise). The FDCPA also establishes what time of day calls can be made at, to whom and where. If a person answers, the call center may track statistics (e.g., the times and days when someone answers) in order to place calls at times when the debtor is more likely to be home; typically this is done by an automated dialing system between the times of 8am and 9pm local standard time. The collector may not use illegal and deceptive practices (for example, threatening the debtor with arrest or impersonating law enforcement). The collector cannot use obscene language and must inform the debtor of the nature of the call (collecting a debt) and their name and the name of the collection company when requested. International debt collection is a less common and specialised field. Not many companies specialize in this sort of collection as there may be a need to speak different languages and have a knowledge of the different legal systems and laws. International collection calls are often made in a different language than used in the collecting company. Collection agencies are sometimes allowed to contact individuals other than the debtor, usually in an attempt to locate the debtor but without mentioning the debt. In the US under the FDCPA a collector is permitted to call a neighbor or relative for help in locating the person who owes a debt. Collectors may only ask for "address, home phone number, and place of work." Collectors are "not permitted to discuss [the] debt with anyone other than [the debtor], [their] spouse, or [their] attorney." [8] The debtor can give permission to the collection agency to speak to somebody else besides the above mentioned. Collectors must state their name and must give the name of their employer if the person specifically asks. They may only contact each person once, unless it is believed that the person gave the collector incorrect or incomplete information at the time, but now has complete or updated information.[7] Collectors may contact a debtor at the workplace unless the collector has been informed the employer prohibits such calls,[9] in which case the collector must cease all calls to the debtor's workplace immediately. At times a person with no connection to the debt or the debtor may be contacted by a collector by error. Examples include victims of identity theft and people erroneously targeted due to a similar name. Alternatively, the alleged debtor may dispute that the debt is payable. In such cases the alleged debtor can require that the collector or creditor prove that the debt is payable—in no jurisdiction does a debt exist merely because a collector says so. In the United States under the FDCPA, anyone has the right for any reason to request written validation of the debt or to demand the collector cease communication. Currently I'm in appeal as the Federal District Court Magistrate pretended as if a legitimate case had been initiated. Funny, I have a written correspondence from the Assistant Deputy Prosecutor at the court specifically indicating that prosecution HAD NOT BEEN INITIATED. Not only that, but the State Judge who attempted to arraign me repeatedly refused to give me a copy of the alleged verified complaint. Maybe because she didn't have one. Now given all of this, how does the Federal District Court Magistrate think she can pretend that a case was lawfully brought against me. She hasn't even seen a valid verified complaint to allow her to make such a decision. This is a multi-million dollar scam going on in all of the States. If any one knows of how Federal Judges might benefit from this please message me. If any one has evidence that the State Courts have investors (ie: they are registered as businesses on Dunn and Bradstreet, so are the lawyers and judges investing in their own business?) or any other private profit please contact me. Right to ample notice - A default does not strip you of your rights or make you a criminal. Banks have to follow process and give you time to repay dues before repossessing your assets to realise the arrears. Typically, banks initiate such proceedings under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interests (Sarfaesi) Act. If the borrower's account is classified as a non-performing asset (NPA), where repayment is overdue by 90 days, the lender has to first issue a 60-day notice to the defaulter. "If the borrower fails to repay within the notice period, the bank can go ahead with sale of assets. However, in order to sell, the bank has to serve another 30-day public notice mentioning details of the sale," says banking and management consultant V.N. Kulkarni. 2. Right to ensure fair value - The lender starts the process of auctioning your property to recover dues if you fail to clear what you owe or respond during the 60-day notice period. However, before doing so, they will have to issue another notice specifying the fair value of the secured asset as assessed by the banks' valuers, along with other details like reserve price, date and time of auction. "The borrower can object if the property is undervalued. He can justify his objection by conveying any better offer that he may have so that the bank can make a decision," says Kulkarni. In other words, you can look for prospective buyers on your own and introduce them to the lender if you think that the property can yield a better price. 3. Realise balance proceeds - Do not write off your asset mentally the moment it is repossessed. Keep track of the auction process—it's easier to do so now as most lenders conduct e-auctions. Lenders are required to refund any balance after recovering the dues, which is a real possibility given that property prices can shoot up beyond the owed amount. "After recovering the dues and all expenses of conducting the auction, the bank has to refund the amount to the borrower as the money belongs to him legitimately," says Kulkarni. 4. Right to be heard - During the notice period, you can make your representation to the authorized officer and put forth your objections to the repossession notice. "The officer has to reply within seven days, giving valid reasons if he rejects the representation and objections raised by the borrower," says Kulkarni. 5. Right to humane treatment -Do not forget that banks are regulated entities that cannot behave like moneylenders while trying to collect dues. Following adverse reports about the conduct of recovery agents, the RBI had pulled up banks over the issue a few years ago. Banks too decided to voluntarily commit to certain best practices as part of their code of commitment to customers. For one, agents can contact borrowers at a place chosen by the latter. In case they have not specified a place, the agents can visit either the borrower's residence or place of work. They are required to respect borrowers' privacy during these visits and ensure civil and decent behavior. They also cannot land up at unearthly hours. The window available is 7 am to 7 pm, unless the borrower's working hours necessitate different timings. Agents cannot resort to harassment or intimidation and nor can they humiliate the borrowers or their family members. A consumer is one who is the decision maker whether or not to buy an item at the store, or someone who is influenced by advertisement and marketing. Every time someone goes to a store and buys a shirt, toy, beverage or anything else, they make a decision as a consumer. Consumer refers to any person who purchases some goods for a consideration that has been either 1.paid or promised to pay or 2.partly paid and partly promised, or 3.found under any system of deferred payment and does include any user of this type of goods other than the person who purchases these types of goods for consideration paid or promised or partly paid or partly promised, or 4.under any type of system of deferred payment when this type of use is done with the agreement of such person, and does not include a person who gets such goods for resale or for any business purpose or hires or avails of some services for a consideration which has been paid or promised or partly paid and partly promised, or 5.under some system of deferred payment as well as includes some beneficiary of such services other than the people who ‘hire or avail of the services for consideration paid or promised, or partly paid and partly promised, or 6.under any system of deferred payment, when such services are provided having the approval of the first described person and does not include a person who takes such services for any business purposes. Consumer Court is the special purpose court, in India, that deals with cases regarding consumer disputes and grievances. These are judiciary hearings set up by the government to protect the consumer rights. To lodge a complaint, the consumer has to first register on the site. The online registration form has to be filled in with the name, email, address and phone number of the complainant, and an user id and password have to be created. Korea's largest tobacco company is pitching a perfect game so far in the court of law. Out of four court cases filed against them by individuals seeking compensation for smoking-related illnesses..., KT&G has won them all. But now it's the National Health Insurance Service's turn, and they think they've got a much better chance of winning. Connie Kim reports. To recover medical costs incurred due to tobacco-related illnesses,... the National Health Insurance Service has filed a 52-million U.S. dollar complaint against the nation's biggest tobacco company KT&G, as well as Phillip Morris and British American Tobacco. The amount claimed is based on the big data analysis of the amount spent on cancer patients suffering from lung or laryngeal over the past 10 years. The health agency says nearly 4-percent of its total health insurance payouts have gone toward tobacco-related treatments since 2011. For each pack of cigarettes that is sold in the country, about 34 cents goes to the government, or about 1-and-a-half billion dollars annually. Officials of the agency say they are taking up the case because they're having a hard time keeping health costs down. "As you all are well aware, smoking cigarettes affects the nation's people, and especially women and adolescents. We are going to proceed with the legal battle for the future of our nation, and to guarantee that health insurance costs are maintained." The announcement by the agency comes on the heels of a Supreme Court decision late last week, in which the tobacco company KT&G won a 15-year-long legal battle against individuals who were seeking compensation for their smoking-related illnesses. Out of a total of four tobacco-related lawsuits in the nation, none of the plantiffs have won. The health insurance service, however, believes they have a stronger case. Connie Kim, Arirang News.
