The EU regulation 261 explains how each of these compensation claims can be made. With regards to flight delay claims, the following main rules apply for compensation: Which airline and airports are affected by flight delay claims? - The flight must have DEPARTED from an EU airport, operating by ANY airline; In this case the EU airport would include Heathrow, Gatwick, Manchester, Birmingham, Leeds, Southampton, Liverpool, Stansted, Bristol or any other UK airport; Or - It must be ARRIVING into an EU airport and be operated by an EU airline. The time of delay and rules about the delayed flight - The flight delay needs to be at least three hours late. Amount of flight delay compensation The amount of flight compensation depends on the distance travelled. Kevin states that the regulation that is spoken about is the EC Regulation 261/2004 and that covers all flights that are departing from the EU or a flight coming back into the EU with an EU carrier. To make it more clearer, if your flight is departing from England or Wales then you may be entitled to compensation, if you're coming back into England and Wales from Germany, France or Spain because you're within the EU, you may well be entitled to compensation. If you're coming from America or the Far East it depends which airline you are travelling with. It has to be an EU carrier e.g. British Airways, Virgin. If you fly with Delta, American Airline or Emirates you are not covered on EU Regulations because they are not EU carriers. Kevin says that the key point is that you have to arrive more than 3 hours then your scheduled arrival time, not when you depart. If you depart 3 hours and 10 minutes late and the airline makes some time up on route and they arrive 2 hours 55 minutes late, you're not entitled to compensation. The definition of when you arrive is when the doors open on your aircraft, some airlines may try and argue that it is when the wheels touch the ground but its when you are actually landed, you've reached your gate and the doors open, that's when you have arrived.
