Deferred Sales Trust - Real Estate Investment Tips

It basically takes the concept of something that is very familiar with even novice investors. The concept of the seller carry back -- or seller financing...that is when the seller has equity in a property and acts as the lender for the new buyer. The buyer then makes payments to the former owner as if they were the bank. Let's say you have a commercial building that you originally bought for $1M cash that is now worth $2M. You sell the property and for whatever the reason may be, you don't do a 1031 exchange. BUT, you still don't want to pay your capital gains taxes. Now, to make this a VERY rough estimate, if you buy a $1m property and sell it in 5 years for $2m with commissions, your capital gains taxes would be around $132,000... Not only that, but the cost recovery amount due is another $23,000...that's a total of $155k that you are now going to have to pay because you didn't exchange into a new property!!! Well...a deferred sales trust is how you get around this. You start the deferred sales trust in a similar way you would start the 1031 exchange. You find a company you trust and let them know of your properties situation, along with the new buyer so everyone is in constant communication. Once the new buyer is ready to close escrow on your property, you sell the property to the intermediary company, and...THEY sell the property to the new buyer...just the way it happens in a 1031 exchange. Simultaneously, the new buyer gives the intermediary the money -- again just like a 1031 exchange, but the last step is where it gets different. The intermediary does NOT give you any money. Instead, you and the intermediary will have already worked out a "seller financed" style agreement...let's say a fully amortized 30 year loan at 8%. Then, they INVEST the money - in stocks, bonds, and annuities, whatever -- with the simple goal of paying you back. They simultaneously give you a NOTE stating that they owe you that $2M over 30 years at 8%. This is where it's similar to seller financing. With seller financing, the new BUYER pays you monthly based on whatever terms you agree upon. With a deferred sales trust, an intermediary pays you in the same agreed upon way! So there are probably a few questions you might have. Let me go over some of the more common ones I get. First -- is it legal. Yes, it is legal and is pursuant to Section 453 of the Internal Revenue Code. Secondly, what is the limit I can put in a deferred sales trust? Well, if you're single its $5M per person, per year. If you're married, then its $10M. Third -- What happens to the deferred sales trust when I pass away?? If you set it up properly with the rest of your estate, your heirs will inherit it and continue receiving payments. Next, will the deferred sales trust be safe from my creditors? Most likely, your deferred sales trust is NOT safe from your creditors... And now the biggest and most important question...What -- if any -- taxes do I have to pay when doing a deferred sales trust?? First and foremost, the $23k cost recovery taxes will have to be paid immediately once you sell. Next is the large $132k in capital gains tax. This capital gains tax is paid back as you receive the PRINCIPLE of the payments. If the note was set up to be interest only for 10 years with a huge $2M lump sum on year 11, then you pay 0% capital gains tax for 10 years and the full $132k on the 11th year. In OUR example, we used a fully amortized 30 year loan...meaning in the taxes due in the beginning are relatively small, and tax payments become larger as time progresses. Finally, the interest of 8%. This 8% interest you make monthly will be taxed at whatever your ordinary income rate is taxed. Again, using the two examples we mentioned, if this is an interest only loan for 10years, you will pay ONLY ordinary income tax for 10 years but NONE of the $132k capital gains tax. In our full 30 year loan example, you will pay a relatively larger amount of ordinary income tax at first, but the payments will become smaller as time progresses. Deferred sales trusts aren't usually the preferred method when selling property -- usually that's a 1031 exchange. But if by chance you can't or are unable to do so, you can always alleviate the taxes burden -- even if it's just for an extended amount of time...now that's good to know.

S. Korea, Australia extend currency swap deal to boost trade, stabilize markets

Based on the Australian dollar -- the world's fifth most-traded currency... it doubles the amount from the previous arrangement. Song Ji-sun introduces to us the new deal... expected to stabilize the markets in times of crisis... and boost trade between the two countries. The Bank of Korea and the Reserve Bank of Australia on Wednesday announced that they will extend their currency swap deal by another three years for double the amount allowed for in the previous agreement signed in 2014. The new deal allows for the exchange of up to 9 trillion won, or 10-billion Australian dollars, which is about 7-point-7 billion U.S. dollars. The two central banks noted the swap deal was sealed to facilitate trade, boost economic development and help stabilize financial markets. Currency swap deals help countries hedge risk against financial turmoil... by allowing one country to borrow money from another using its own local currency, thus reducing its exposure to radical exchange rate fluctuations. Australia is South Korea's eighth-largest trading partner... and its dollar is the fifth most-traded currency in the world. Australia's AAA rating from Standard & Poor's is a notch higher than Korea's AA rating. The BOK previously extended its currency swap deal with Malaysia just two weeks ago... and is seeking to renew its swap arrangements with the United Arab Emirates and Indonesia. HSBC HQ Read more here at The Star Newspaper: TRX investors heave sigh of relief PUTRAJAYA: The Government lifted the uncertainties hanging over the Tun Razak Exchange (TRX) development by promising to inject more funds to see through its completion. The decision would help investors who have sunk in billions into the 70-acre development at the heart of Kuala Lumpur, yet are unable to get financing from banks due to it being part of scandal-riddled 1Malaysia Develop­ment Bhd (1MDB). Finance Minister Lim Guan Eng said the Government had decided that the TRX project would go on and it would provide financial assistance to the tune of RM2.8bil to TRX City Sdn Bhd (TRXC) to complete the project. TRXC was originally a subsidiary of 1MDB and set up specifically to undertake the development. When 1MDB could not meet its debt obligations, TRXC was transferred to the Finance Ministry in March 2017. Investors who purchased parcels of land in the project have been in limbo for the past year. Bank financing was hard to come by. When Barisan Nasional lost the Federal Government to Pakatan Harapan on May 9, the situation became worse for investors. Lim said the present government’s commitment would help allay concerns among local and foreign investors. “There are wide ramifications if the project is not completed. We must make sure that investors are reassured that their investments will not just disappear,” said Lim during a press conference at the Treasury building here. Lim also disclosed that more than RM3bil had been “misappropriated” from TRXC by 1MDB and were mainly used for its loan repayments. Because of this, Lim said TRXC did not have the necessary funds to complete the project and sought the Government’s assistance. The Government, he said, had extended advances, provided transfers and even bought land from TRXC for a total RM3.69bil since 2012. Injecting RM2.8bil into the project, said Lim, was a better alternative to paying compensation claims. “The alternative is to pay RM3.51bil in compensation claims, as well as an eyesore of an abandoned mega-project in the heart of Kuala Lumpur,” he said. In addition, the Government will also lose the RM3.7bil that has already been sunk into TRXC so far. TRXC is the master developer of two projects – the TRX financial district and the 486-acre Bandar Malaysia development. Including the RM2.8bil injection into TRXC, the Government’s total funding outlay into the company is RM6.5bil. Lim said that by completing TRX, the Government expected to realise at least RM7.6bil, which would go towards repaying the TRXC borrowings, including the sums misappropriated by 1MDB, recover all funding investments and opportunity costs, as well as potentially achieve a small surplus return. TRXC has, to date, sold parcels of land to local and foreign investors including Mulia Property Development, HSBC and Affin Bank. On whether the name Tun Razak Exchange would remain, Lim said it was the prerogative of Prime Minister Tun Dr Mahathir Mohamad, although he was of the opinion it need not change. “It is called Tun Razak, not Najib Razak.” Meanwhile, Datuk Seri Najib Tun Razak has cautioned Lim for making factually incorrect statements about TRXC, saying the take-over of TRXC by MOF Inc for a nominal sum of RM1 effective March 31, 2017, was a key step in the broader 1MDB rationalisation plan. “Lim himself admits that even with a further ‘up to’ RM2.8bil injection by MOF Inc, the TRX project will be worth at least RM7.8bil and show a profit. “Surely it cannot be called a bailout if the money is to be used to generate a profit?” Najib said in a Facebook posting last night.
