The Responsibility of International Organizations and the International Law Commission: A Conversation between Professors Georg Nolte, member of the International Law Commission, and José E. Alvarez, NYU The responsibility of international organizations has been an important concern of the international community for some years. In 2011, the International Law Commission adopted the "Draft Articles on Responsibility of International Organizations." These articles will be debated in the UN General Assembly's Sixth Committee. In addition, cases before the European Court of Justice and the European Court of Human Rights (in particular Kadi/Behrami/Al-Skeini/Al-Jedda) have raised significant questions about the human rights obligations of the United Nations as well as member states cooperating with UN actions. Such questions have arisen in the course of implementing UN sanctions or undertaking UN peacekeeping operations. Have the ILC and international judges asked the right questions and reached the right answers with respect to allocating responsibility on the UN? What is the International Law Commission's role in resolving such issues? Prof. Georg Nolte, member of the International Law Commission, and Prof. J.E. Alvarez, the Herbert and Rose Rubin Professor of Law at NYU School of Law, addressed these issues in the form of a conversation at New York University School of Law.

VO Local budget management causes NA concern INTRO: The responsibilities of provincial assemblies in approving budget plans and granting rights to provincial administrations to use money they have collected in excess of the target plan has raised concerns among some National Assembly (NA) members. STORY: The concerns were raised by National Assembly (NA) members on Wednesday when debating the amendments to the Law on the State Budget at the ongoing ordinary session. Minister of Finance Dr Lien Thikeo introduced the draft amendment to their session on Tuesday. The newly created Article No.28 in the draft amendment to the Law on the State Budget, which stipulates the responsibilities of provincial people's assemblies, says the assemblies have to take responsibility for the consideration and approval of revenue collection and expenditure plans, according to proposals by the provincial governors and the capital mayor. Speaking at the debate, an NA member for Savannakhet province Bounpone Sisoulath, was concerned that the stipulation would be a loophole for authorities in the provinces and capital to propose revenue collection plans as they pleased. He mentioned about the current practices of village authorities who demand various fee payments from residents as an example. Regarding granting rights to provincial administrations on using the money they collected as a surplus over the set target for local development in the following year, NA members pointed out both positive and negative aspects in this regard. They said on the one hand the policy would promote proactiveness by authorities in terms of revenue collection. However they wanted accurate consideration about the amendment in order to prevent the unregulated use of budget funds. The Ministry of Finance's Budget Department Director General Dr Bounleua, representing the amendment sub-committee, explained the difference between being over balance and being over the target plan. He said that Vientiane, for example, earned more money than its expenses, so it had to hand the additional amount to the state budget. However, he said, if a province earned more than the target set by the ministry, the additional money will be included into the expenditure of the province in the following year.

Article 6. Issuance and Receipt of a Reimbursement Authorization or Reimbursement Amendment a. All reimbursement authorizations and reimbursement amendments must be issued in the form of an authenticated teletransmission or a signed letter. When a credit or amendment thereto which has an effect on the reimbursement authorization is issued by teletransmission, the issuing bank should advise its reimbursement authorization or reimbursement amendment to the reimbursing bank by authenticated teletransmission. The teletransmission will be deemed the operative reimbursement authorization or reimbursement amendment, and any subsequent mail confirmation shall be disregarded. b. An issuing bank must not send to a reimbursing bank: i. a copy of the credit or any part thereof, or a copy of an amendment to the credit in place of, or in addition to, the reimbursement authorization or reimbursement amendment. If such copies are received by the reimbursing bank they shall be disregarded; ii. multiple reimbursement authorizations under one teletransmission or letter, unless expressly agreed to by the reimbursing bank. c. An issuing bank shall not require a certificate of compliance with the terms and conditions of the credit in the reimbursement authorization. d. A reimbursement authorization must (in addition to the requirement of Article 1 for incorporation of reference to these rules) state the following: i. credit number; ii. currency and amount; iii. additional amounts payable and tolerance, if any; iv. claiming Bank or, in the case of a credit available with any bank, that claims can be made by any bank. In the absence of any such indication, the reimbursing bank is authorized to pay any claiming bank; v. parties responsible for charges (claiming bank's and reimbursing bank's charges) in accordance with Article 16 of these rules. A reimbursement amendment must state only the relative changes to the above and the credit number. e. If the reimbursing bank is requested to accept and pay a time draft, the reimbursement authorization must indicate the following, in addition to the information specified in (d) above: i. tenor of draft to be drawn; ii. drawer; iii. party responsible for acceptance and discount charges, if any. A reimbursement amendment must state the relative changes to the above. An issuing bank should not require a sight draft to be drawn on the reimbursing bank. f. Any requirement for: i. pre-notification of a reimbursement claim to the issuing bank must be included in the credit and not in the reimbursement authorization; ii. pre-debit notification to the issuing bank must be indicated in the credit. g. If the reimbursing bank is not prepared to act for any reason whatsoever under the reimbursement authorization or reimbursement amendment, it must so inform the issuing bank without delay. h. In addition to the provisions of Articles 3 and 4, the reimbursing bank is not responsible for the consequences resulting from non-reimbursement or delay in reimbursement of reimbursement claims when any provision contained in this article is not followed by the issuing bank or claiming Bank.

In this article I'll explore partnerships—what they are, how to form one, and their advantages and disadvantages. Partnership defined A partnership is a business structure owned by two or more persons who agree to carry on business together for a profit but decide not incorporate or form a limited liability company. There are three types of partnerships: general, limited, and limited liability partnerships. In a general partnership, profits, losses, and managerial responsibilities are shared equally among the partners. Each partner has unlimited personal liability, which means that any or all of each partners' personal assets can be taken in a lawsuit or to settle a debt. A limited partnership is not a partnership in the typical sense. Rather, it is better viewed as an investment financing arrangement. In a limited partnership, there are two classes of partners: the general partner who has unlimited liability and the limited partner whose personal liability is limited to their investment in the business. The general partner manages the business while the limited partner remains silent on the sidelines. The general partner has full legal and financial responsibility for the business while the limited partner remains uninvolved in the management of the business. They typically have no personal liability beyond their investment in the business. Limited partnerships are commonly used for short-term projects, such as filmmaking, or for real estate investments. A limited liability partnership is only available to certain professions, licensed by the state, such as accountants, attorneys, doctors, and engineers. The personal assets of the partners in a limited liability partnership cannot generally be used to satisfy business debts and liabilities. However, the limited liability partnership does not protect the partners for their own negligence or malpractice. In this video, I want to focus our attention on the most common type of partnership, the general partnership. How to form a general partnership Like a sole proprietorship, a general partnership is relatively easy to set up and maintain, as no paperwork is usually required to create it. Once you and at least one other person get together and sell a product or service for money, a general partnership has begun. Partnership status confers solely and automatically from the business activities of you and your partner. And partnership law automatically applies to your business and to you as partner. Each partner contributes to all aspects of the business, including money, property, labor and talent. In return each partner shares in the profits and losses of the business. As with most things, it is usually a good idea to have things in writing, so you should invest the time needed to draft a written partnership agreement. If you don't, the partnership laws of your state will govern how your partnership will operate. Your partnership agreement should include: how the business will be financed; who will do what work; what happens if a partner dies or becomes disabled; and what happens if a partner wants to leave. Partnerships and the IRS The IRS considers a general partnership a "pass-through" entity, which means that, like a sole proprietorship, profits and losses flow through to the partners' individual income tax returns. All the partners will share in the profits and losses of the business as well as be jointly and severally liable for all of its debts, liabilities, and obligations. Each general partner has equal responsibility and authority to run the business and to bind it. What this means is that any one partner can commit the partnership by entering into an agreement on behalf of the partnership. And all the remaining partners will be personally liable, regardless of whether they authorized the agreement or even knew of its existence. Because each partner has unlimited personal liability, a general partnership is the most dangerous type of entity to form. Not only can you be held liable for any agreement your partner enters into, you can also be held liable for any partner's negligence. In addition, each partner is personally liable for all of the partnership's obligations. For example, if you are one of ten partners, you are not responsible for just ten percent of the partnership's obligations. You are responsible for 100 percent. If the other partners are unable to pay their respective shares, you'll be responsible for the entire amount. The shared ownership attribute that characterizes a partnership has distinct advantages and disadvantages. Hot on the heels of the successful passage of the Transitional Justice bill, the DPP caucus is in a hurry to push through amendments to the referendum law, which would lower the widely-criticized high threshold for participation, which is 50% of all eligible voters. The investigators said the attack killed 42 people and injured 34 of the more than 140 people onboard. "This civilian vessel was almost certainly attacked using a 7.62 mm caliber weapon from an armed utility helicopter," the investigators, who monitor sanctions in Yemen, wrote in a 185-page report to the U.N. Security Council on Monday. "The Saudi Arabia led coalition forces are the only parties to the conflict that have the capability to operate armed utility helicopters in the area," the report said. It said the helicopter was likely operating from a naval vessel. The coalition intervened in Yemen in 2015 in support of the internationally recognized government of President Abd-Rabbu Mansour Hadi. It includes Egypt, the United Arab Emirates, Bahrain, Kuwait, Jordan, Morocco, Senegal and Sudan. The U.N. report said the attack violated international humanitarian law and threatened the peace, security and stability of Yemen. It said two other alleged attacks on fishing vessels by helicopter or naval vessels in the Red Sea in March had killed another 11 people and injured eight. It said the Saudi-led coalition, the governments of the UAE and Egypt and the Combined Maritime Forces had not responded to the investigators' requests for information. The coalition receives U.S. arms and logistical support. "Some individual member states of the Saudi Arabia-led coalition seek to hide behind 'the entity' of the coalition to shield themselves from state responsibility for violations committed by their forces," the investigators said. They did not identify the states by name. "Attempts to divert responsibility in this manner from individual states to the Saudi Arabia-led coalition may contribute to further violations continuing with impunity," they wrote. Top U.N. officials this month accused the warring parties in Yemen and their international allies of fueling an unprecedented deadly cholera outbreak, driving millions closer to famine and hindering humanitarian aid access. U.N.-led peace talks have stalled. At U.S. Ambassador Nikki Haley's suggestion, the Security Council is considering sending letters to the warring parties reminding them of their humanitarian obligations. National Assembly (NA) members say the Law on Procurement will close all loopholes causing losses to the state budget and punish those who violate the bidding system in relation to state-funded development projects. NA members expressed their thoughts when debating a draft of the Law on Procurement at the ongoing Assembly session last week, presided over by Assembly Vice President Dr Bounpone Bouttanavong. Speaking at the debate, NA member for Borikhamxay province, Mr Souvanny Xaysana, reminded those present of misconduct around the use of state resources such as tender bidding processes, which were often only ceremonial and consequently added to the public debt. He explained about bid rigging and collusion, saying there was cheating to share benefits among companies participating in tender bidding, between the companies and bidding committee, and between the authorities who have the power to approve projects and the bidding participants. Mr Souvanny wanted the seventh part of this law, which provides stipulations concerning prohibitions, to clarify the punishment for such violations. “This part of the law should better clarify responsibilities and measures. The first violation of the rule, involving cheating, must be subject to a warning. The second time bidders are caught cheating they must be fined or no longer have the right to participate in tender bidding for similar projects,” Mr Souvanny said. “The officials, the members of the bidding committee who violated the regulations, should be banned from rejoining the committee,” he added. He also wanted the stipulations in the Law on Procurement to be similar to measures taken against drug traffickers. Article No. 22 of the Law on Procurement refers to direct procurement without tender bidding for urgent needs. NA member for Xieng Khuang province, Mr Vilaysouk Phimmasone, suggested the Ministry of Finance take responsibility for any government projects and qualify companies to compete in tender bidding. He also said it would better ensure transparency in procurement and the bidding process if a so-called Ministry of Material Supply were to take responsibility. NA member for Saravan province Mr Bounpone Sisoulath wanted bidding committees to investigate the background of the companies participating in tenders, and for all bid amounts to be made known. Mr Bounpone also wanted inspections to prevent companies from the same group colluding in the same tender bidding process together. “This law must close this loophole,” he said. The drafting committee said that articles Nos. 17, 18, 22, 31, 40, 44, 45 will have separate explanations. But NA members said they were concerned the promulgation would be delayed until the explanations were in place, which they said was occurring slowly. President Paul Kagame has assured the Rwandan Diaspora and friends that Rwanda is a peaceful country where everyone is supportive of each other. The Rwandan head of state was speaking at Rwanda Cultural Day convened in San Francisco, California. Commended for championing gender equality, the president was inquired about the possibility of living in Rwanda as LGBT (Lesibian, Gay, Bisexual and Transgender). For President Kagame who first took a minute-long pause, said,” it hasn’t been our problem. And we don’t intend to make it our problem.” According to Article 26 of Rwanda’s constitution, “Only civil monogamous marriage between a man and a woman is recognized. No person may be married without his or her free consent. Parties to a marriage have equal rights and duties upon and during the subsistence of a marriage and at the time of divorce. The law determines conditions, forms and effect of marriage.” However, sexual orientation is a private matter, not a state business. Rwanda is considered a leader in the progress on human rights for LGBT persons in East Africa. In 2010 Rwanda eliminated the criminalisation provision from its draft code and recently signed two UN resolutions on sexual orientation and gender identity, as the only African nation to do so. Free News Sharing and On-Line Art Gallery http://www.ciactivist.org FEATURE: The 2016 Fire and Rain art project that began in early January was inspired by news stories on wildfires that burned throughout Western Canada in 2015. Paintings were displayed outdoors publicly throughout Edmonton and their stories shared on YouTube. I used art from the beginning to defend freedom of expression on the Alberta Legislature grounds when it was verbally banned 3 times by Legislature officials. Some of the YouTubes published shared how the wildfires and flooding that followed affected Albertans, their communities and the environment. I hope my art and the stories shared will inspire us to contemplate the calamities in Alberta of 2016 as a collective and together help each other find ways and better solutions to save our planet and our children's future. ISLAMABAD: Amid its failure to enact a law to provide legal and constitutional cover to the Ruet-i-Hilal Committee, the government has decided to adopt strict attitude with Mufti Shahabuddin Popalzai this year too so that the Shawwal crescent sighting does not become controversial in the country once again. Pakistan has witnessed controversies during previous years as two Eids were observed in the country mainly because the independent cleric Mufti Shahabuddin Popalzai of Masjid Qasim Ali Khan in Peshawar disregarded the decisions of the committee and made separate announcements over sighting of the Shawwal moon. However, with no time left for parliamentary proceedings, as the government cannot get the draft bill on the committee approved by both the houses of parliament, the Ministry of Religious Affairs has decided to forward the matter to the interior ministry. With term nearing end, govt unlikely to get draft bill on Ruet-i-Hilal Committee approved by both houses of parliament “This is a matter of serious concern and we do not want to see that there are two Eids in any part of the country even after we are not in government,” said Minister for Religious Affairs Sardar Muhammad Yousuf. ARTICLE CONTINUES AFTER AD “There are issues with one or two persons only and they (interior ministry) will send Mufti Popalzai to Dubai again this year so that people can celebrate Eid together,” he added. The government’s tenure ends on May 31 while Eidul Fitr is expected in the mid of June. However, the minister said that certain things were beyond party lines and whosoever formed the next government would adopt the same course of action. Though the matter has been lingering for several years, the government has failed to enact a law to provide legal and constitutional cover to the Ruet-i-Hilal Committee. The Ministry of Religious Affairs forwarded the draft law to the cabinet secretariat for approval in December 2017 but it has not been taken up by the latter yet. Mr Yousuf said a nine-member central Ruet-i-Hilal Committee was set up in 1974 under a resolution passed by the National Assembly. Now the committee comprises 26 members but so far it has not been provided constitutional and legal cover and there is no proper criteria of selection of its members. The matter was first taken up by Senator Hafiz Hamdullah of the JUI-F, chairman of the Senate Standing Committee on Religious Affairs, who asked the ministry to clear the issue in June 2016 while saying that the main reason of the conflict over moon sighting was the lack of legal and constitutional status of the Ruet-i-Hilal Committee. Since the matter is a devolved subject under the 18th Amendment, resolutions under Article 144 of the Consti­tution were required from the provincial assemblies to give constitutional cover to the Ruet-i-Hilal Committee. It took the government around 19 months to complete the formalities and in December 2017, the Ministry of Religious Affairs forwarded the draft bill to the federal cabinet for approval. The draft bill envisages that TV channels announcing moon-sighting before a formal announcement by the Ruet-i-Hilal Committee will be fined up to Rs1 million and may also face suspension of their licences. The draft bill suggests six-month imprisonment or Rs50,000 fine or both for those providing false evidence of moon-sighting. Meanwhile, parliamentarians have criticised the government for not taking the issue seriously though the controversy over moon-sighting creates a negative impression of the country at global level. “There should not be any state within a state and it is the duty of the government only to announce moon-sighting but at the same time the government should take this responsibility seriously,” Ali Muhammad Khan, member of the National Assembly Standing Committee on Religious Affairs, said. He said non-serious attitude of the government gave space to non-state actors to play a role in moon sighting.

War Escalation, Canada Marijuana, FBI Hack, EU Regime, Senate Snoopers TRANSCRIPT: The Ron Paul Institute for Peace and Prosperity welcomes you to Five Minutes Five Issues. Starting in five four three two one. Hello, I am Adam Dick, a Ron Paul Institute senior fellow. Let’s start. Issue one. “When will Congress act and carry out its constitutional responsibility? The American people are tired of endless wars. And putting these wars on remote control — with no debate and no votes — is shameful.” Those are the closing words of a speech Rep. Jim McGovern (D-MA) presented Tuesday on the United States House of Representatives floor. McGovern was speaking in response to the announcement this week that over 200 more US troops will be sent to the Middle East for the ISIS War. McGovern, along with a bipartisan group of representatives, has been advocating for Congress to fulfill its constitutional responsibility to debate and vote on the ISIS War. But, their effort has been blocked by congressional leaders. Senate Majority Leader Mitch McConnell (R-KY), House Speaker Paul Ryan (R-WI), and Ryan’s predecessor John Boehner (R-OH) prefer that Congress cede unlimited power to President Barack Obama and whoever the next president may be. Issue two. Canada Prime Minister Justin Trudeau promised to seek to implement marijuana legalization on the national level when he ran for office last year. On Wednesday, Canada Health Minister Jane Philpott announced in a United Nations General Assembly speech that legislation to accomplish the promised marijuana legalization will be introduced in the Canada parliament in the spring of next year. Like in America, where in recent years some state and local governments have moved away from the war on marijuana, some province and local governments in Canada have also in recent years significantly liberalized marijuana policies. Unless a surprise move comes in the United States Congress, it looks like country-wide legalization will come to Canada before America. Issue three. Federal Bureau of Investigation (FBI) Director James Comey revealed Thursday that the FBI spent well over a million dollars on a hacking tool to overcome the security of an iPhone related to a San Bernardino, California mass murder investigation. Exactly how much more was spent Comey hasn’t said. But, hey, it’s not like the FBI is spending its own money. The hacking occurred after iPhone-maker Apple resisted an ex parte court order the FBI had obtained to force Apple to do the hacking. Just as there has long been plenty of reason to expect, it now looks like that iPhone has little to no information of value regarding the mass murder investigation or potential terrorist attacks. But, that is just a small issue on the path to the FBI’s ultimate goal — easy access to people’s private electronic information. Issue four. The Obama administration has worked to accomplish regime change in Libya, Syria, and Ukraine. However, the president thinks at least one sort of regime change is wrong. Obama, in a Friday London Telegraph editorial, urged people in Great Britain to vote in June for staying in the European Union (EU). Given Obama’s history of bad calls on regime changes, maybe British people would do well to consider Obama’s editorial as a factor weighing in favor of voting for a “Brexit.” Issue five. Senate Intelligence Committee Chairman Richard Burr (R-NC) and Vice Chairman Dianne Feinstein (D-CA) have made it clear on which side of the so-called Apple vs. FBI privacy debate they stand. As I wrote in a Ron Paul Institute article on Monday, the two Senators have “released draft legislation intended to empower courts to require Apple and others to, as Feinstein puts it, ‘render technical assistance or provide decrypted data’ in criminal investigations.” Fear of terrorism is being used to sell the need to defeat encryption and other privacy protections on electronic information. But, reading through the Burr-Feinstein draft legislation it is clear that terrorism is just the public relations talking point. Indeed, the draft legislation explicitly applies the privacy-stripping power to a list of criminal investigations, including that old standby excuse for liberty violations — drug crime investigations. ----- That’s a wrap. The cybercrime, 'fabricate and spread false information ' was formally introduced as a criminal offense; Websites may also be held criminally responsible. The freedom of expression on the Internet is being further supressed. Changes to protect juridical power of the court have also been introduced. It imposes tough procedure for human rights lawyers. Once the online remarks are officially recognized as 'fabricating, spreading false information ', it may constitute a criminal offense. The corresponding websites ' failure to monitor the content or withhold relevant information as evidence may also be subject to criminal penalties. These are the major changes in the ninth draft amendment to criminal law submitted to the NPC. An administrative penalty such as warnings and fines was used to be the measure for the so-called Internet rumors. In the NPC 's decision on Internet security article five, those who commit crimes via the Internet will be held 'criminally responsible in accordance with the relevant provisions of the criminal law. ' However, provisions on conviction and sentencing or relevant articles were not defined. The crimes of 'fabricating and spreading false information ' in the ninth amendment draft claimed to target fabricating and spreading of malicious and false information that cause disruption of social order. The responsibility of websites is also added in the draft. Network service providers are in charge of cyberspace security and maintenance. Damages caused by massive spreading of illegal information and leakage of personal information or loss of criminal evidence which could complicate the judicial investigation will be held accountable for criminal offense. Holding the website accountable for 'loss of evidence ' has been written into the criminal law for the first time. Similar situations were subject to administrative penalties. But, now it is involved in criminal penalties. Former Hebei People's Radio Editor Zhu Xinxin: "It increased the responsibility of the Websites. With such a responsibility, service providers can be regulated in the name of the law and the sites can be blocked or closed. The Internet is further tightened." Zhu Xinxin does not believe the tightened online censorship is beneficial to developments of the culture or society. Zhu Xinxin: "When the true voice is suppressed, people will divert their energy and attention to the pursuit of material. The standard of spiritual and cultural pursuit will be reduced and the power will be further unsupervised. Without supervision, the rule of law will never be achieved." Another change adopted by the draft is the modification that secures the court jurisdiction in order to strengthen social governance after the abolition of the labor camp. The scope of the 'disrupt court order ' crime was extended to include the activities that 'insult, slander, threaten judicial officers or participants in the proceedings, refuse to stop as demanded by the court ' as criminal offense. Guangdong lawyer Sui Muqing: "It is obviously and deliberately targeting the human rights lawyers ' opposing the illegal acts of the court. Technically, 'disrupt court order ' is a very vague and abstract description. It provides free will to the court to arbitrarily incriminate lawyer." However, with no time left for parliamentary proceedings, as the government cannot get the draft bill on the committee approved by both the houses of parliament, the Ministry of Religious Affairs has decided to forward the matter to the interior ministry. With term nearing end, govt unlikely to get draft bill on Ruet-i-Hilal Committee approved by both houses of parliament “This is a matter of serious concern and we do not want to see that there are two Eids in any part of the country even after we are not in government,” said Minister for Religious Affairs Sardar Muhammad Yousuf. ARTICLE CONTINUES AFTER AD “There are issues with one or two persons only and they (interior ministry) will send Mufti Popalzai to Dubai again this year so that people can celebrate Eid together,” he added. The government’s tenure ends on May 31 while Eidul Fitr is expected in the mid of June. However, the minister said that certain things were beyond party lines and whosoever formed the next government would adopt the same course of action. Though the matter has been lingering for several years, the government has failed to enact a law to provide legal and constitutional cover to the Ruet-i-Hilal Committee. The Ministry of Religious Affairs forwarded the draft law to the cabinet secretariat for approval in December 2017 but it has not been taken up by the latter yet. Mr Yousuf said a nine-member central Ruet-i-Hilal Committee was set up in 1974 under a resolution passed by the National Assembly. Now the committee comprises 26 members but so far it has not been provided constitutional and legal cover and there is no proper criteria of selection of its members. The matter was first taken up by Senator Hafiz Hamdullah of the JUI-F, chairman of the Senate Standing Committee on Religious Affairs, who asked the ministry to clear the issue in June 2016 while saying that the main reason of the conflict over moon sighting was the lack of legal and constitutional status of the Ruet-i-Hilal Committee. Since the matter is a devolved subject under the 18th Amendment, resolutions under Article 144 of the Consti­tution were required from the provincial assemblies to give constitutional cover to the Ruet-i-Hilal Committee. It took the government around 19 months to complete the formalities and in December 2017, the Ministry of Religious Affairs forwarded the draft bill to the federal cabinet for approval. The draft bill envisages that TV channels announcing moon-sighting before a formal announcement by the Ruet-i-Hilal Committee will be fined up to Rs1 million and may also face suspension of their licences. The draft bill suggests six-month imprisonment or Rs50,000 fine or both for those providing false evidence of moon-sighting. Meanwhile, parliamentarians have criticised the government for not taking the issue seriously though the controversy over moon-sighting creates a negative impression of the country at global level. “There should not be any state within a state and it is the duty of the government only to announce moon-sighting but at the same time the government should take this responsibility seriously,” Ali Muhammad Khan, member of the National Assembly Standing Committee on Religious Affairs, said. He said non-serious attitude of the government gave space to non-state actors to play a role in moon sighting.

According to Powell, Article Eight of the convention allows parties to the accord to call on the United Nations to take action to prevent and suppress acts of genocide. Powell called on the United Nations (UN) to undertake a full investigation. At the UN on Wednesday, the United States circulated a draft resolution that calls for a stronger international force to monitor the situation in Darfur. The resolution would also threaten punitive action against the country's oil exports if the government doesn't act quickly to stop militia attacks and improve the security situation. The Bush administration has said that as a result of actions by government-backed militias, tens of thousands of Darfur residents have died and more than 1.2 (m) million have been displaced from their homes. The two rebel movements - the Sudanese Liberation Army and the Justice, Equity Movement - draw their support from African tribes in the Darfur region. The Sudanese government is accused of backing the Janjaweed in an effort to stamp out the rebellion - a charge the government denies. Later during on Thursday, Powell met Dr John Garang, Chairman of the Sudan People's Liberation Movement. The Perilous State of the University: Jonathan Haidt & Jordan B Peterson
I recently traveled to New York University to talk with Dr. Jonathan Haidt about, among other things, disgust, purity, fear and belief; the perilous state of the modern university; and his work with Heterodox Academy (https://heterodoxacademy.org/) an organization designed to draw attention to the lack of diversity of political belief in the humanities and the social sciences. The Constitution, originally comprising seven articles, delineates the national frame of government. Its first three articles embody the doctrine of the separation of powers, whereby the federal government is divided into three branches: the legislative, consisting of the bicameral Congress; the executive, consisting of the President; and the judicial, consisting of the Supreme Court and other federal courts. Articles Four, Five and Six embody concepts of federalism, describing the rights and responsibilities of state governments, the states in relationship to the federal government, and the shared process of constitutional amendment. Article Seven establishes the procedure subsequently used by the thirteen States to ratify it. What approaches do Indigenous media-makers adopt in doing their work? How well are mainstream and alternative media doing in considering and representing Indigenous perspectives to both Native and non-Native audiences? What work still needs to be done? Bios: Jocelyn Formsma is a member of the Moose Cree First Nation and currently lives in Ottawa, ON. Jocelyn has extensive experience in children's rights and youth engagement and has a Bachelor of Social Sciences in Public Administration. She is currently pursuing her law degree from the University of Ottawa and will graduate in 2015. She is a film maker and host of "The Circle", a radio show featuring Indigenous artists and issues, on CHUO the Ottawa U campus radio station. Jennifer David was born and raised in northern Ontario and is a member of Chapleau Cree First Nation. She has spent her career working in and supporting Aboriginal media in Canada, first at Television Northern Canada, then as APTN's first Director of Communications, then as a consultant with Debwe Communications. Jennifer has a degree in Journalism from Carleton University and currently runs her own First Nation management consulting company called Stonecircle. She recently self-published a book about the launch of APTN: "Original People, Original Television". Howard Adler is an award winning writer, and an artist that has worked in diverse mediums, including visual art, sound art, stained glass, theatre, dance, video editing, and film. In 2009 he won the Canadian Aboriginal Youth Writing Challenge (19-29 age category) with his video script "Johnny Seven Fires". He is currently the Co-Director of the Asinabka Festival, an Indigenous film and media arts festival that had its inaugural year in Ottawa in June 2012. Howard is Jewish and Anishinaabe and a member of Lac des Mille Lacs First Nation in North-western Ontario.
